Welcome to The Kemistry Laboratory! These Terms of Service (“Terms”) govern your access to and use of our website, products, and services provided by The Kemist, doing business as Kemistry Lab (referred to as "we," "us," or "our"). By accessing or using www.KemistryLab.com (the “Site”), you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Site.

Eligibility:

By using our Site, you represent and warrant that you are at least 21 years of age and that you possess the legal authority to enter into this agreement. You also agree to provide accurate and truthful information when creating an account or making a purchase. If you are under 21 years of age, you are not permitted to use this Site or make any purchases.

Prohibited Activities:

You agree not to use the Site for any unlawful or prohibited purpose. Prohibited activities include, but are not limited to:

• Engaging in any activity that violates any applicable laws or regulations.
• Uploading or transmitting viruses, malware, or any other harmful code.
• Attempting to gain unauthorized access to the Site, other accounts, or computer systems or networks connected to the Site.
• Interfering with or disrupting the Site or servers connected to the Site.
• Using the Site to engage in any form of fraud or deceptive practices.

Product Descriptions:

We strive to provide accurate descriptions of our products on the Site. However, we do not warrant that the descriptions, colors, information, or other content available on the Site are accurate, complete, reliable, current, or error-free.

Pricing:

Prices for products are subject to change without notice. We reserve the right to modify or discontinue any product at any time without liability. In the event that a product is listed at an incorrect price due to an error, we reserve the right to cancel any orders placed for that product.

Order Acceptance:

We reserve the right to refuse or cancel any order at our sole discretion. Reasons for order cancellation may include, but are not limited to, product unavailability, errors in product or pricing information, or suspected fraud. Please note that The Kemist does not ship products internationally. We only ship within the United States.

Payment:

You agree to pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the prices in effect when such charges are incurred. You are responsible for paying any applicable taxes related to your purchases.

Shipping:

We will ship products in accordance with our shipping policies, which may be updated from time to time. Shipping times are estimates and are not guaranteed. We are not responsible for delays in shipping caused by carriers, weather, or other circumstances beyond our control.

Please note that we do not ship products outside of the United States.

Risk of Loss: 

All items purchased from The Kemist are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

If an item is missing from your package, please reach out within 24 hours of delivery with photos of the box, packing slip, and any damaged or tampered packaging. Claims submitted outside of this window may not be eligible for replacement.

Ownership:  

All content on the Site, including text, graphics, logos, images, audio clips, video clips, software, and other materials, is the property of The Kemist, doing business as Kemistry Lab, or its licensors and is protected by intellectual property laws.

License:

We grant you a limited, non-exclusive, non-transferable license to access and use the Site and its content for personal, non-commercial use. Any unauthorized use of the Site or its content may violate intellectual property laws and these Terms.

The Site and all products and services provided by Kemistry Lab are provided “as is” and “as available,” without any warranties of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You assume all risk of using the Site and any products or services obtained through the Site.

To the fullest extent permitted by applicable law, Kemistry Lab and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, resulting from (a) your use of the Site, (b) your purchase or use of any products or services, (c) any unauthorized access to or use of our servers and/or any personal information stored therein, (d) any interruption or cessation of transmission to or from the Site, or (e) any errors or omissions in any content on the Site.

You agree to indemnify, defend, and hold harmless doing business with Kemistry Lab, its officers, directors, employees, agents, and affiliates, from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your violation of these Terms, or your violation of any rights of another.

These Terms and your use of the Site will be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Philadelphia, PA.

Kemistry Lab can send transactional or promotional messages for online shop customers with a link to the shop, promoted online. Message frequency varies. Text HELP for help. Text STOP to cancel. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

We reserve the right to modify these Terms at any time, so please review them frequently. Changes and clarifications will take effect immediately upon their posting on the Site. Your continued use of the Site following the posting of changes to these Terms will constitute your acceptance of those changes.
